TERMS AND CONDITIONS OF THE GIVEAWAY KANG IN JERSEY

 

 

These Terms and Conditions (hereinafter, the "Terms and Conditions") may be consulted by the participants on the website https://atleticodemadrid.qualifioapp.com/1825939 throughout the period of the draw (hereinafter, the "Draw"). FIRST. – NAME AND PURPOSE 

 

Club Atlético de Madrid S.A.D, (hereinafter, “Club Atlético de Madrid”), with NIF A-80373764 and registered offices in Avenida de Luis Aragonés nº4, 28022, Madrid, registered in the Mercantile Register of Madrid, organises a promotional action (hereinafter, the "Promotion") that aims to promote Club Atlético de Madrid. 

 

Club Atlético de Madrid announces the Draw in the interest of promoting and marketing its products and services in which all those who have registered correctly can participate, in compliance with the provisions of clause FOUR of these Terms and Conditions. Specifically, a random Draw will be made among all those who have participated and fulfilled the aforementioned requirements. 

 

The Draw will be governed in accordance with the following clauses: 

 

SECOND. - GEOGRAPHICAL SCOPE AND TIMESCALE 

 

Participation in the Draw without territorial limits. The period of participation in the Draw will run from July, 25 to August 31 of 2026 at 23:59pm (Madrid time zone). Outside this period the answers received will not be taken into account. 

THIRD. - PARTICIPANTS 

 

Only persons who meet all the requirements set out in these Terms and Conditions are eligible to participate in the Draw (hereinafter, the "Participant" or the "Participants"). 

 

The following are excluded from participation in the Draw: 

 

FOURTH. - METHOD OF PARTICIPATION IN THE DRAW 

 

In order to participate in the Draw, the Participant must enter the website https://atleticodemadrid.qualifioapp.com/1825939 and fill out the form .

 

SIXTH. - COMPETITION DRAW AND DECISION 

 

The Draw will take place on September 2, 2026, among all those who have participated correctly and have fulfilled the conditions stipulated in these Terms and Conditions. 

 

The selection of the 3 (three) winners of the Draw will be randomly selected (hereinafter, the "Winner"). At the same event, 2 ([two]) alternates will be selected, in the event that one of the winners cannot be located as stipulated below (hereinafter, the "Substitute" or the “Substitutes”). 

 

The decision of the Draw will be final and will be communicated to the Winner via the email address used by the Participant to participate in the Draw and will also be announced in the official Club Atlético de Madrid media. 

 

The Winner will have a maximum period of twenty-four (24) hours from their notification to accept the Prize and communicate it to Club Atlético de Madrid in the manner indicated. In the event of acceptance, Club Atlético de Madrid may request all the information and/or documentation that it considers necessary to accredit compliance with the participation requirements set out in these Terms and Conditions and other applicable regulations, as well as any other additional information and/or documentation that Club Atlético de Madrid considers necessary. Failure to submit the required information and/or documentation will result in disqualification from the Prize Draw and loss of status as a Winner. 

 

In the event that no response is received within the indicated period, if the Winner refuses to accept the Prize or does not comply with the requirements of these Terms and Conditions, Club Atlético de Madrid will withdraw the condition of Winner, awarding it to the first Substitute, who will become the Winner. In the event that it is not possible to contact him/her within twenty-four (24) hours, or that he/she rejects the Prize or does not comply with any of the requirements of these Terms and Conditions, he/she will also be eliminated, with the second Substitute becoming the Winner and so on up to 2 ([two]) Substitutes. Club Atlético de Madrid assumes no liability whatsoever to the Participants who have not responded. 

 

All entries that do not meet the above requirements will not be considered valid and will therefore not be eligible for the Prize. 

 

Participation in the Draw is free of charge, so that no fee is required to enter and win the Prize. Only one (1) entry per person and/or registered user will be allowed. 


 

SEVENTH. - PRIZE 

The Prize is personal and non-transferable and may not be exchanged for any other item, either in cash or in kind. 

 

Waiver of the Prize will not give any right to any indemnity or compensation whatsoever. 

 

The Winner of the Prize must assume the legal obligations that correspond to them in relation to obtaining the Prize in accordance with current law. 

 

The Prize will be awarded to the winner on a personal basis and may not be transferred or assigned to third parties, whether free of charge or not. The Prize shall not be exchangeable for money and may not be replaced by another prize at the request of the Winner. If the Prize is not accepted by any of the Winners, it will be forfeited and non-refundable. Club Atlético de Madrid reserves the right to substitute the Prize for another similar one with an equal or higher value, for any supervening causes that justify it. 

 

Club Atlético de Madrid will not be responsible for circumstances that prevent the enjoyment of the Prize in the event of force majeure or fortuitous events, or for causes that are not attributable to it or that are beyond the control of Club Atlético de Madrid (for example, prizes consisting of travel, flight cancellations, lack of valid personal documentation for travel, etc.). 

 

This Draw and/or the Prize may be declared void. To accept the Prize the Winner authorizes: 

 

 

 

EIGHTH. – TAX OBLIGATIONS 

 

The Prize will be subject to current tax legislation and the Winner must assume the applicable tax obligations in connection with receiving the Prize. 

 

If the winner is a resident of Spain and the value of the Prize awarded for the purpose of tax deductions exceeds three hundred Euros (€300), the corresponding tax payment will be Club Atlético de Madrid's responsibility and will be paid by Club Atlético de Madrid a in accordance with the applicable rates as of the date of accrual of the transaction. The tax payment will not be recovered from the Winner, being assumed by Club Atlético de Madrid, consequently, said payment will mean a higher value of the Prize in kind received by the Winner. 

 

If the Winner is not a resident of Spain, it will be necessary to consider their tax residence to determine the tax treatment of the Prize under applicable current tax legislation. For these purposes, and if applicable, the Winner must provide a certificate of tax residence for the purposes of the Convention signed between Spain and the Winner's country of residence to avoid double taxation. 

 

Likewise, and where relevant, Club Atlético de Madrid will send to the Winner, in accordance with the aforementioned regulations, the corresponding certificate of tax deductions and payments. 

 

NINTH. - LIABILITY 

 

Club Atlético de Madrid reserves the right to remove any participant that defrauds, alters or disables the proper functioning or the normal and regulatory course of this Draw.  

 

Club Atlético de Madrid reserves the right not to accept someone's participation in the Draw if they do not comply with the provisions set out in these Terms and Conditions. 

 

Club Atlético de Madrid likewise reserves the right to invalidate the entry of any users who attempt to participate through fraudulent means, or for fraudulent or illegal purposes. The foregoing is without prejudice to the appropriate legal measures that could be taken according to the particular circumstances. 

 

Club Atlético de Madrid shall be exempt from any liability to the participants if this Draw needed to be cancelled or suspended due to force majeure or as required by law, a situation that would be appropriately brought to the attention of the Participants. 

 

Club Atlético de Madrid is exempt from any liability with respect to any incidents that are beyond its control that might arise affecting the Participants and the Prize.  

 

Club Atlético de Madrid will under no circumstances be held responsible for media coverage of the Draw and, in particular, of the personal data and images of the Participants and/or the Winner, consequently, it is exempt from any liability in connection with any potential complaints made by the Winner, Participants and/or third parties arising as a result of the opinions and/or statements made and/or the use of images and/or personal data by the media in connection with the Participants and/or people that may appear in said images. 

 

Club Atlético de Madrid accepts no liability for any kind of damages that, despite the security measures taken, may arise due to the improper use of the services and content by Participants. 

 

Club Atlético de Madrid organizes this Draw in good faith, and as such will not be liable for any loss or damage arising from the participation of any person in the Draw, or with respect to the Winner's enjoyment of the Prize, for causes not attributable to Club Atlético de Madrid. By participating in the Draw, participants release and hold harmless Club Atlético de Madrid from any liability arising from claims that may result from their participation in the Draw or enjoyment of the Prize. 

 

TENTH. - INTELLECTUAL PROPERTY 

 

The Participants undertake and are responsible for ensuring that they have the appropriate permission and/or are holders of the intellectual property rights or image rights of the same with which they participate in the Draw and grant Club Atlético de Madrid the use and exploitation of the same for the maximum time permitted by law. 

 

ELEVENTH. – PUBLICATION OF THE IDENTITY OF THE WINNER 

 

The Winner accepts that his/her name will be published in the official media of Club Atlético de Madrid.  

 

In addition to the above, the Winner authorizes Club Atlético de Madrid, without territorial limit, from the moment of acceptance of these Terms and Conditions, to publish, disseminate and use, by all written, spoken and filmed media, in any form by any means and on any support, his/her name, image and voice, for the entire period of protection conferred by law and for all countries in the world. 

 

TWELFTH. - PROTECTION OF PERSONAL DATA OF THE WINNERS AND PARTICIPANTS IN THE DRAW 

 

We inform you that your data will be processed in accordance with the provisions of Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights and EU Regulation 2016/679 and will be included in a register of processing activities for which Club Atlético de Madrid, S.A.D. is responsible. These data will be stored in this register for the period of time indicated in the regulations and the purpose will be the MANAGEMENT OF THE DRAW/PROMOTION, as well as to inform you of our products and services, including by electronic means, with your prior consent. Club Atlético de Madrid may make use of the Winner's data, which may be published in the Club's electronic media or social networks, in order to inform of the activities, and the purpose of the use will be exclusively linked to the proper functioning of the Promotion and always related to the activities carried out in the same, and will only be processed when they are appropriate, relevant and not excessive in relation to the scope and purposes determined. 

 

You may exercise before Club Atlético de Madrid, S.A.D. the rights of access, rectification or deletion, limitation of processing, opposition, portability, and to oppose automated individual decisions. Likewise, you may revoke your consent in the event that you have given it for a specific purpose, and you may modify your preferences at any time. THIRTEENTH. - MODIFICATION OF THE TERMS AND CONDITIONS 

 

Club Atlético de Madrid reserves the right to modify the Terms and Conditions of the Draw, partially or totally. In the same way, Club Atlético de Madrid is empowered to, at its discretion, resolve any contingency not foreseen in the Terms and Conditions, based on the spirit and purpose of the same. 

 

FOURTEENTH. - APPLICABLE LAW AND JURISDICTION 

 

These Terms and Conditions are governed by Spanish Law. 

 

Club Atlético de Madrid and the Participants submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that may correspond to them. 

 

Club Atlético de Madrid reserves the right to take legal action against those persons who carry out any type of act that could be considered manipulation or falsification of the Prize. 

Erroneous, incomplete or similar entries, and/or entries that have taken place outside the participation period or that do not comply with the requirements of these Terms and Conditions will not be valid. 

 

FIFTH. - ACCEPTANCE 

 

Participation in this Promotion implies the participants' acceptance of all the Terms and Conditions provided in this document, which must be complied with, and any claims as to the Terms and Conditions waived.
