TERMS AND CONDITIONS OF THE “FLY TO THE DERBI” DRAW
These Terms and Conditions (hereinafter, the “Terms and Conditions”) may be consulted by participants on the website http://www.atleticodemadrid.com/atm/fly-to-the-derbi (hereinafter, the “Website”) for the duration of the contest (hereinafter, the “Contest”). Club Atlético de Madrid announces the Draw in the interest of promoting and marketing its products and services in which all those who have registered correctly can participate, in compliance with the provisions of clause FOUR of these Terms and Conditions. Specifically, a random Draw will be made among all those who have participated and fulfilled the aforementioned requirements.
The Draw will be governed in accordance with the following clauses:
There will be no territorial limits for participation in the Contest. Participations from all Spanish territories are excluded.
The period of participation in the Competition will begin on October 10, 2025 and will run until December 31, 2025. Outside this period, applications received will not be taken into account, unless the period of participation in the Competition is extended as communicated by Club Atlético de Madrid.
Participation in the Promotion is free of cost and all Atleti Red & White International members of legal age and who meet all the requirements established in these Rules may participate in the Contest.
The following are excluded from participation in the Draw:
To participate in the Contest, Atlético de Madrid will announce via social media the launch of the Promotion. The Participant must enter the Website and register on the platform provided for this purpose (hereinafter the “Platform”) through a registration form in which he/she will be asked to log in with their club credentials and confirm his/her name, surname, telephone number, country of origin and date of birth.
All entries that do not meet the above requirements will not be considered valid and will therefore not be eligible for the Prize.
Only one participation per person and/or registered user will be allowed.
Entries that are erroneous, incomplete or similar cases, and/or that have taken place outside the participation period or that do not comply with the requirements of these Rules will not be valid.
Likewise, entries that include any of the following elements in any submission related to the Contest, including videos or other content posted on third party platforms, will not be valid: (a) vulgarity, profanity, nudity or adult-oriented, sexually explicit or inappropriate material; (b) materials related to lotteries or gambling; (c) explicit language or content, images of violence or promotion of illegal activities; (d) content that violates intellectual and/or industrial property rights or laws; (e) false, libelous, slanderous, defamatory, disparaging, tortious or defamatory materials; (f) content that denigrates, disparages or reflects negatively on Club Atlético de Madrid and its sponsors, its employees, officers and directors, or soccer as a sport; (g) tobacco, electronic cigarettes, alcohol or drugs; (h) dangerous stunts or real weapons of any kind, including but not limited to guns, knives or projectiles; (i) material that promotes bigotry, racism, hatred or harm against any group or individual or that promotes discrimination on the basis of race, sex, religion, national origin, disability, sexual orientation, age or any other basis protected by law, ordinance or regulation; (j) audio, visual and/or multimedia content owned by third parties; and (k) material that is illegal or that violates or is contrary to the laws or regulations of any jurisdiction in which the submission was created, including but not limited to laws relating to privacy or publicity rights.
Participation in the Draw is free of charge, so that no fee is required to enter and win the Prize.
Participation in this Promotion implies the participants' acceptance of all the Terms and Conditions provided in this document, which must be complied with, and any claims as to the Terms and Conditions waived.
The winner will receive as a prize the opportunity to be part of the Atleti Esports team during the 24/25 season. This includes the possibility of signing a training contract, training services, psychological counseling, official Atlético de Madrid sportswear, the possibility of participating in official tournaments of the FC Pro professional circuit and visibility in the club's social networks.
The Prize is personal and non-transferable and cannot be exchanged for any other element, neither in cash nor in kind.
The waiver of the Prize will not give rise to any right of indemnity or compensation.
The Winner of the Prize must assume the legal obligations that correspond to him/her in relation to the obtaining of the Prize according to the current Law.
Club Atlético de Madrid will not be responsible for the circumstances that prevent the enjoyment of the Prize in case of force majeure or fortuitous event, or for causes that are not attributable to it or that are beyond its control.
This Contest and/or the Prize may be declared void. To accept the Prize, the Winner assumes the following commitments:
- Authorizes Club Atlético de Madrid for the fixation, recording, broadcasting, diffusion and public communication of recorded images or photographs in the framework of the enjoyment of the Prize of the Contest, and the reproduction, in whole or in part, of said images or photographs either individually or in conjunction with other images, photographs or drawings, without time or geographical limitation, and without the right to any compensation or remuneration whatsoever.
- Assigns to Club Atlético de Madrid, without any limitation whatsoever, its image rights in relation to the recorded images or photographs taken of its person in the framework of the Contest.
- Assigns to Club Atlético de Madrid the use of the Work (understanding in this context as such the audiovisual recording submitted in its application for participation) for the maximum time allowed by law, for publication by any means and in any format known or to be invented in the future, for the sole purpose of advertising and promoting the Contest, without in any case Club Atlético de Madrid being able to make any kind of exploitation or use of the Work, other than that mentioned above, without the prior consent of the Winner.
The Prize will be subject to current tax legislation and the Winner must assume the applicable tax obligations in connection with receiving the Prize.
If the winner is a resident of Spain and the value of the Prize awarded for the purpose of tax deductions exceeds three hundred Euros (€300), the corresponding tax payment will be Club Atlético de Madrid's responsibility and will be paid by Club Atlético de Madrid a in accordance with the applicable rates as of the date of accrual of the transaction. The tax payment will not be recovered from the Winner, being assumed by Club Atlético de Madrid, consequently, said payment will mean a higher value of the Prize in kind received by the Winner.
If the Winner is not a resident of Spain, it will be necessary to consider their tax residence to determine the tax treatment of the Prize under applicable current tax legislation. For these purposes, and if applicable, the Winner must provide a certificate of tax residence for the purposes of the Convention signed between Spain and the Winner's country of residence to avoid double taxation.
Likewise, and where relevant, Club Atlético de Madrid will send to the Winner, in accordance with the aforementioned regulations, the corresponding certificate of tax deductions and payments.
Club Atlético de Madrid reserves the right to remove any participant that defrauds, alters or disables the proper functioning or the normal and regulatory course of this Draw.
Club Atlético de Madrid reserves the right not to accept someone's participation in the Draw if they do not comply with the provisions set out in these Terms and Conditions.
Club Atlético de Madrid likewise reserves the right to invalidate the entry of any users who attempt to participate through fraudulent means, or for fraudulent or illegal purposes. The foregoing is without prejudice to the appropriate legal measures that could be taken according to the circumstances.
Club Atlético de Madrid shall be exempt from any liability to the participants if this Draw needed to be cancelled or suspended due to force majeure or as required by law, a situation that would be appropriately brought to the attention of the Participants.
Club Atlético de Madrid is exempt from any liability with respect to any incidents that are beyond its control that might arise affecting the Participants and the Prize.
Club Atlético de Madrid will under no circumstances be held responsible for media coverage of the Draw and, in particular, of the personal data and images of the Participants and/or the Winner, consequently, it is exempt from any liability in connection with any potential complaints made by the Winner, Participants and/or third parties arising as a result of the opinions and/or statements made and/or the use of images and/or personal data by the media in connection with the Participants and/or people that may appear in said images.
Club Atlético de Madrid accepts no liability for any kind of damages that, despite the security measures taken, may arise due to the improper use of the services and content by Participants.
Club Atlético de Madrid organizes this Draw in good faith, and as such will not be liable for any loss or damage arising from the participation of any person in the Draw, or with respect to the Winner's enjoyment of the Prize, for causes not attributable to Club Atlético de Madrid. By participating in the Draw, participants release and hold harmless Club Atlético de Madrid from any liability arising from claims that may result from their participation in the Draw or enjoyment of the Prize.
The Participants undertake and are responsible for ensuring that they have the appropriate permission and/or are holders of the intellectual property rights or image rights of the same with which they participate in the Draw and grant Club Atlético de Madrid the use and exploitation of the same for the maximum time permitted by law.
The Winner accepts that his/her name will be published in the official media of Club Atlético de Madrid.
In addition to the above, the Winner authorizes Club Atlético de Madrid, without territorial limit, from the moment of acceptance of these Terms and Conditions, to publish, disseminate and use, by all written, spoken and filmed media, in any form by any means and on any support, his/her name, image and voice, for the entire period of protection conferred by law and for all countries in the world.
The personal data that participants provide to participate in the sweepstakes through the procedure described in these legal bases will be processed by Club Atlético de Madrid as the data controller, in order to allow their registration and participation in the contest and manage the delivery of the prize in case of winning. The personal data that Club Atlético de Madrid will process within the framework of the sweepstakes are: name, surname, email, image and voice, all of them necessary to participate in the sweepstakes.
The basis of legitimacy of the processing of your data for the purposes indicated above will be the execution of the contractual relationship established upon acceptance of these legal bases.
The data of the participants will be kept by Club Atlético de Madrid during the period for which the contest is developed, as well as blocked for the period of limitation of the actions that may arise from their participation in it.
Notwithstanding the foregoing, the winner's data may be published on the Web or social networks of Atlético de Madrid, Atleti Esports, EA Sports FC Pro and Playstation on Instagram, Twitter or TikTok.
Participants may exercise against Club Atlético de Madrid their rights of access, rectification, deletion, opposition, limitation of processing, portability and not to be subject to automated individual decisions, by sending a letter to marketing@atleticodemadrid.com. Likewise, they may file a claim before the Spanish Data Protection Agency if they consider that Club Atlético de Madrid has violated their rights.
Club Atlético de Madrid reserves the right to modify the Terms and Conditions of the Draw, partially or totally. In the same way, Club Atlético de Madrid is empowered to, at its discretion, resolve any contingency not foreseen in the Terms and Conditions, based on the spirit and purpose of the same.
These Terms and Conditions are governed by Spanish Law.
Club Atlético de Madrid and the Participants submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that may correspond to them.
Club Atlético de Madrid reserves the right to take legal action against those persons who carry out any type of act that could be considered manipulation or falsification of the Prize.
