“CREATORS CLUB 2025” CONTEST TERMS AND CONDITIONS

 

These Terms and Conditions (hereinafter, the "Terms and Conditions") may be consulted by the participants on the website atleticodemadrid.com/creatorsclub (hereinafter, the "Web") throughout the period of the contest (hereinafter, the "Contest"). FIRST. – NAME AND PURPOSE

 

Club Atlético de Madrid S.A.D, (hereinafter, “Club Atlético de Madrid”), with NIF A-80373764 and registered offices in Avenida de Luis Aragonés nº4, 28022, Madrid, registered in the Mercantile Register of Madrid, organises a Contest that aims to promote Club Atlético de Madrid.

 

Club Atlético de Madrid announces the Contest with the interest of selecting one or several content creators who want to develop their talent with the brand "Club Atlético de Madrid" to collaborate with them in different projects, and in which all those who have registered correctly, in compliance with the provisions of clause FOUR of these Terms and Conditions (hereinafter, individually, the "Participant" and, collectively, the "Participants") can participate.

 

SECOND. - GEOGRAPHICAL SCOPE AND TIMESCALE

 

There will be no territorial limits for participation in the Contest.

 

The period of participation in the Contest will run from April 2025, to June 30th, 2026. Outside this period the answers received will not be taken into account, unless the period of participation in the Contest is extended as communicated by Club Atlético de Madrid.

 

THIRD. - PARTICIPANTS

 

Only persons who meet all the requirements set out in these Terms and Conditions are eligible to participate in the Contest (hereinafter, the "Participant" or the "Participants").

 

The following are excluded from participation in the Contest:

 

o Minors under 18 years of age.

o Employees of companies, advertising agencies or promotion agencies involved in this Contest.

o Employees, managers and directors of Club Atlético de Madrid.

o Family members up to the second degree of consanguinity of employees, executives and directors of Club Atlético de Madrid.

o Those persons who have participated fraudulently, falsely, with profiles that do not correspond to reality or that may belong to internet automation systems and acquisitions or profiles catalogued as unsafe or carried out illegitimately.

 

FOURTH. - METHOD OF PARTICIPATION IN THE CONTEST

 

In order to participate in the Contest, the Participant must enter the Web and access the

Contest by means of a prior registration in which he/she will be asked for his/her name, surname, e-mail, telephone number and country of origin, with the enabling of a field to upload to the Web the work created by the Participant (hereinafter, the "Work"). All types of creations are accepted in the following formats: i) images up to 10MB (.jpg, .gif and .png); and ii) videos up to 100MB (.mp4 and .mov).

 

The participation in the Contest is free of charge, so that no fee is required to enter and win the Prize. Only one (1) entry per person and/or registered user will be allowed.

 

Erroneous, incomplete or similar entries, and/or entries that have taken place outside the participation period or that do not comply with the requirements of these Terms and Conditions will not be valid.

 

In addition, entries that include any of the following in any submission in connection with the Contest, including videos or other content posted on third party platforms, will not be eligible: (a) vulgarity, profanity, nudity or adult-oriented, sexually explicit or inappropriate material; (b) materials related to lotteries or gambling; (c) explicit language or content, images of violence or promotion of illegal activities; (d) content that violates intellectual property rights or laws; (e) false, libelous, slanderous, defamatory, disparaging, tortious or defamatory materials; (f) content that denigrates, disparages or reflects negatively on Club Atlético de Madrid, its employees, officers and directors, or football as a sport; (g) tobacco, electronic cigarettes, alcohol or drugs; (h) dangerous stunts or real weapons of any kind, including but not limited to guns, knives or projectiles; (i) material that promotes bigotry, racism, hatred or harm against any group or individual or that promotes discrimination on the basis of race, sex, religion, national origin, disability, sexual orientation, age or any other basis protected by law, ordinance or regulation; (j) audio, visual and/or multimedia content owned by third parties; and (k) material that is illegal or that violates or is contrary to the laws or regulations of any jurisdiction in which the submission was created, including but not limited to laws relating to privacy or publicity rights.

 

All entries that do not meet the above requirements will not be considered valid and will therefore not be eligible for the Prize.

 

FIFTH. - ACCEPTANCE

 

Participation in this Contest implies the participants' acceptance of all the Terms and Conditions provided in this document, which must be complied with, and any claims as to the Terms and Conditions waived.

 

SIXTH. - COMPETITION CONTEST AND DECISION

 

Club Atlético de Madrid will internally analyse and evaluate all the candidatures under its own criteria and will select the winners on June 30th, 2026, unless the participation period is extended, among all the Participants that have participated correctly and have fulfilled the conditions stipulated in these Terms and Conditions.

 

The selection of the winner/s of the Contest will be made by Club Atlético de Madrid on the basis of criteria such as the quality of the Work and development potential. At the same event, up to a maximum of four (4) winners will be selected, depending on the level of the candidatures, according to the criteria of a jury determined by Club Atlético

de Madrid (hereinafter, the "Winner").

 

The decision of the Contest will be final, will be communicated to the Winner through the email address that the Participant used to participate in the Contest, and will also be announced in the official media of Club Atlético de Madrid.

 

The Winner will have a maximum of twenty-four (24) hours from the time that Club Atlético de Madrid sends the communication to accept the Prize and communicate it to Club Atlético de Madrid in the manner indicated. In case of acceptance, Club Atlético de Madrid may request all the information and/or documentation that it considers necessary to accredit compliance with the participation requirements foreseen in these Terms and Conditions and other applicable regulations, as well as any other additional information and/or documentation that Club Atlético de Madrid considers necessary. Failure to submit the required information and/or documentation will result in disqualification from the Contest and the Winner's condition will be forfeited.

 

In the event that no response is received within the indicated period, if the Winner refuses to accept the Prize or does not comply with the requirements of these Terms and Conditions, Club Atlético de Madrid will withdraw the condition of Winner. Club Atlético de Madrid assumes no liability whatsoever to Participants who do not respond within the time period specified above.

 

SEVENTH. - PRIZE

 

The Winner will receive as a prize the visibility of his/her Work in the different platforms and/or sales channels of Club Atlético de Madrid, which in any case will be proposed by Club Atlético de Madrid to the Winner depending on the type of Work and its potential for development (hereinafter, the "Prize").

 

The Prize is personal and non-transferable and may not be exchanged for any other item, either in cash or in kind.

 

Waiver of the Prize will not give any right to any indemnity or compensation whatsoever.

 

The Winner of the Prize must assume the legal obligations that correspond to them in relation to obtaining the Prize in accordance with current law.

 

Club Atlético de Madrid will not be responsible for circumstances that prevent the enjoyment of the Prize in the event of force majeure or fortuitous events, or for causes that are not attributable to it or that are beyond the control of Club Atlético de Madrid (for example, prizes consisting of travel, flight cancellations, lack of valid personal documentation for travel, etc.).

 

This Contest and/or the Prize may be declared void. To accept the Prize the Winner authorizes:

 

- I authorize Club Atlético de Madrid to fix, record, broadcast, disseminate and publicly communicate recorded images or photographs in connection with the enjoyment of the Prize, and the reproduction, in whole or in part, of such images or photographs either individually or in conjunction with other images, photographs or drawings, without time or geographical limitation, and without

the right to any compensation or remuneration from Club Atlético de Madrid.

 

- I assign to Club Atlético de Madrid, without limitation, my image rights in relation to any recorded images or photographs taken of me in connection with the Contest.

 

- I grant Club Atlético de Madrid the use of the Work for the maximum time permitted by law, by any means and in any known format or any format that may be invented in the future, for the sole purpose of publishing and promoting the Contest. Under no circumstances may Club Atlético de Madrid make any type of exploitation or use of the Work, other than that mentioned above, without the prior consent of the Winner.

 

EIGHTH. – TAX OBLIGATIONS

 

The Prize will be subject to current tax legislation and the Winner must assume the applicable tax obligations in connection with receiving the Prize.

 

NINTH. - LIABILITY

 

Club Atlético de Madrid reserves the right to disqualify any Participant who defrauds, alters or disables the proper functioning and normal course of this Contest and, therefore, does not comply with the conditions detailed in these Terms and Conditions.

 

Club Atlético de Madrid also reserves the right to invalidate the participation of those users who attempt to participate through fraudulent means, or for fraudulent or illicit purposes. All of this without prejudice to the appropriate legal measures that may be taken according to the circumstances of each case, in addition to the aforementioned cases of force majeure or unforeseen circumstances, among others.

 

Club Atlético de Madrid will be exempt from any responsibility towards the Participants, if due to force majeure or legal imperative the present Contest has to be cancelled or suspended, a situation that will be made known to the Participants.

 

Participants expressly assume all risks and special situations that may arise from the use or enjoyment of the Prize obtained as a result of the Contest.

 

Club Atlético de Madrid organizes this Contest in good faith, and as such will not be liable for any loss or damage arising from the participation of any person in the Contest, or with respect to the Winner's enjoyment of the Prize, for causes not attributable to Club Atlético de Madrid. By participating in the Contest, participants release and hold harmless Club Atlético de Madrid from any liability arising from claims that may result from their participation in the Contest or enjoyment of the Prize.

 

TENTH. - INTELLECTUAL PROPERTY

 

Participants undertake and are responsible for ensuring that they are holders of the intellectual property rights or rights to the images and Works with which they participate in the Contest. Likewise, the Participants grant Club Atlético de Madrid the use of the Works by any means and in any known format or that may be invented in the future, and

in particular the right to fix, reproduce, distribute, publicly communicate, make available and transform, advertise, and promote the Works within the framework of the Contest, for the maximum time permitted by Law and without territorial limit. The exploitation and any other use of the Work is in any case subject to prior agreement with the Winner.

 

ELEVENTH. – PUBLICATION OF THE IDENTITY OF THE WINNER

 

The Winner accepts that his/her name will be published in the official media of Club Atlético de Madrid.

 

In addition to the above, the Winner authorizes Club Atlético de Madrid, without any territorial limitation, from the moment of acceptance of these Terms and Conditions, to publish, disseminate and use, by all written, spoken and filmed media, in any form by any means and on any support, his/her name, image and voice, for the entire period of protection conferred by law and for all countries in the world.

 

TWELFTH. - PROTECTION OF PERSONAL DATA OF THE WINNERS AND PARTICIPANTS

 

We inform you that your data will be processed in accordance with the provisions of Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights and EU Regulation 2016/679 and will be included in a register of processing activities for which Club Atlético de Madrid, S.A.D. is responsible. These data will be stored in this register for the period indicated in the regulations and the purpose will be the MANAGEMENT OF THE CONTEST, as well as to inform you of our products and services, including by electronic means, with your prior consent. Club Atlético de Madrid may make use of the Winner's data, which may be published in the Club's electronic media or social networks, in order to inform of the activities, and the purpose of the use will be exclusively linked to the proper functioning of the Contest and always related to the activities carried out in the same, and will only be processed when they are appropriate, relevant and not excessive in relation to the scope and purposes determined.

 

You may exercise before Club Atlético de Madrid, S.A.D. the rights of access, rectification or deletion, limitation of processing, opposition, portability, and to oppose automated individual decisions. Likewise, you may revoke your consent in the event that you have given it for a specific purpose, and you may modify your preferences at any time. THIRTEENTH. – INDEPENDENCE

 

The Participant and Club Atlético de Madrid acknowledge that at the time of signing these Terms and Conditions, no relationship of dependence or employment relationship, common or special, exists between them, nor is created by reason of these Terms and Conditions.

 

Likewise, no stipulation of these Terms and Conditions shall be interpreted in the sense that they constitute a commercial relationship of independent service provider, a community or corporate entity, nor a grouping of economic interest, temporary joint

venture or any other joint-venture formula.

 

FOURTEENTH. - MODIFICATION OF THE TERMS AND CONDITIONS

 

Club Atlético de Madrid reserves the right to modify these Terms and Conditions of the Contest, partially or totally. In the same way, Club Atlético de Madrid is empowered to, at its discretion, resolve any contingency not foreseen in these Terms and Conditions, based on the spirit and purpose of the same.

 

FIFTEENTH. - APPLICABLE LAW AND JURISDICTION

 

These Terms and Conditions are governed by Spanish Law.

 

Club Atlético de Madrid and the Participants submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that may correspond to them.

 

Club Atlético de Madrid reserves the right to take legal action against those persons who carry out any type of act that could be considered manipulation or falsification of the prize.
